Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Opsenes (“Opsenes”, “we”, “us”, or “our”) and govern your access to and use of the Opsenes website, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use or suspected security breach.

2. Acceptable use

You agree not to use the Service to:

• violate any applicable law, regulation, or third-party right;
• upload or transmit malicious code, or interfere with the integrity or performance of the Service;
• attempt to gain unauthorized access to any system, account, or data; or
• reverse engineer, resell, or sublicense the Service except as expressly permitted.

3. Customer content

You retain all rights to the data and materials you submit to the Service (“Customer Content”). You grant Opsenes a limited, worldwide license to host, process, and display Customer Content solely to provide and improve the Service. You are responsible for ensuring you have the necessary rights and permissions for the Customer Content you submit.

4. Subscriptions and payment

Paid plans are billed in advance on a recurring basis according to the plan you select. Fees are non-refundable except where required by law. We may change pricing with prior notice, effective at the start of your next billing cycle.

5. Intellectual property

The Service, including its software, design, and trademarks, is owned by Opsenes and its licensors and is protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service other than the limited right to use it as described here.

6. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ends, and we may delete Customer Content in accordance with our data retention practices.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Opsenes will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Service.

9. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
